司法建议助推社会治理之进路分析——从浙江等地法院实践出发

摘　　要：本文基于对浙江等地人民法院司法建议实践情况的考察,认为其在国家治理体系和治理能力现代化进程中,能够发挥修复制度漏洞、回应群众关切、推进社会治理、助推法治政府建设等作用。但现阶段,因为功能定位不清,在主体、载体、流程、监督问效机制等方面规范不足,司法建议真正转变为社会治理决策和措施的比重较低,司法建议工作助力社会治理的潜能未能充分释放。故应从立法方面赋予司法建议制度有效参与社会治理的功能定位,规范文书内容、有效改进文书质量,提升司法建议的针对性与可操作性,健全司法建议内外联动的工作机制,靶向施策、精准治理,提高社会治理法治化、智能化、专业化水平,助力国家治理体系和治理能力现代化。Judicial recommendations represent a crucial responsibility bestowed upon people’s courts by law and constitute an essential part of the court’s work.By examining the practical scenarios of judicial recommendations,this study analyzes their functions within the context of the modernization process of the national system and capacity for governance,including rectifying institutional deficiencies,responding to public concerns,advancing social governance,and promoting the construction of a government under the rule of law.Nevertheless,in the current stage,due to indistinct functional positioning and lack of standardization regarding aspects such as the subject,medium,process,supervision,and effectiveness evaluation mechanisms,the proportion of judicial suggestions converted into social governance decisions and measures is relatively low.Consequently,the potential of judicial recommendations in facilitating social governance has not been fully exploited.It is thus necessary to endow the judicial recommendation system with a clear functional orientation for effective legislative participation in social governance.This involves standardizing the content of relevant documents to enhance their quality;augmenting the pertinence and operability of judicial recommendations;improving the internal-external coordinated working mechanism of judicial recommendation work;implementing targeted and precise governance strategies;and raising the level of legalization,intelligence,and specialization in social governance,thereby contributing to the modernization of the national system and its capacity for governance.
