摘 要:《行政处罚法》对行政处罚中负责人集体讨论程序作出了规定,但对于负责人集体讨论程序所应适用的案件类型、负责人的范围、讨论时点以及受托执法机构负责人开展的集体讨论是否合法等,仍需进一步明确。本文结合《生态环境行政处罚办法》及司法判例,对上述问题进行研究。对生态环境行政处罚中应由负责人集体讨论的具体案件、符合法律规定的负责人范围和讨论时点等问题进行明确,以供生态环境主管部门及所属执法机构在实施行政处罚及当事人在行政处罚程序中依法维护自身合法权益所参考。The‘Administrative Punishment Law’stipulates the collective discussion procedures for the responsible persons in administrative penalties,but it still needs to be further clarified forthe types of cases that should be applied to the responsible person's collective discussion procedure and thescope of responsible persons,the time of discussion,and whether the collective discussion conducted by the person in charge of the entrusted law enforcement agency is legal.These issues were examined in conjunction with the‘Measures for Administrative Penalties for Ecological Environment’and relevant judicial precedents.The specific cases that should be collectively discussed by the responsible persons in the administrative punishment of ecological environment,the scope of the person in charge and the time of discussion in accordance with the law were clarified,so as to provide reference for the competent department of ecological environment and its subordinate law enforcement agencies to impose administrative penalties,and for the parties concerned to safeguard their legitimate rights and interests in accordance with the law in the administrative penalty procedure.
