危险作业罪中“现实危险”的司法认定——以100份相关判决为考察样本

摘　　要：《刑法修正案(十一)》新增危险作业罪,是针对安全生产领域未实际发生重大伤亡事故但有现实危险行为的规制,亦是风险刑法介入社会生活的立法回应。本罪属于具体危险犯,其以造成“现实危险”的严重后果为入罪要求,但司法实践中对如何把握“现实危险”仍存在认定失范现象。文章拟从中国裁判文书网中检索出的100份危险作业罪相关判决书为样本,梳理司法实务中对此罪“现实危险”要件认定存在的诸多问题,并指出司法人员对“现实危险”把握失范的原因。立足于危险作业罪的本质特征,提出综合性判断“现实危险”的理论根基和参考标准,即梳理案件事实中诱因的事实与阻碍结果发生因素;以行为时为节点,通过判断行为对象是否至少出现过一次,且行为创设一种容易发生侵害的危险,此时继续任由事态发展,损害将不可避免出现。以此判断诱因是否使特定法益陷入危急状况之中。The amendment to the Criminal Law(11)make clear the crime of new hazardous operations,which is a regulation for the fact that there are no major casualties in the field of production safety but there are realistic dangerous behaviors.It is also a legislative response to the criminal law involved in social life.This crime is a specific dangerous criminal,and it is a crime requirement for the serious consequences of“reality danger”,but there is still a identification of a moded phenomenon in how to grasp the“real danger”in judicial practice.The article intends to be sampled by the 100 dangerous homework crimes retrieved from the China Magistrate D ocument Network as a sample,sorting out many issues that exist in the“real danger”requirements for this crime in judicial practice.s reason.Based on the essential characteristics of the crime of hazardous homework,propose the theoretical foundation and reference standards of comprehensive judgment of“reality danger”,that is,the factors and obstacles of the facts and obstacles in the facts of the case;Once once,and behavior creates a danger that is prone to infringement.At this time,it will continue to let the situation develop,and the damage will inevitably occur.To determine whether the cause of the induction has caused specific legal benefits into a crisis.
