农村出身的体制内工作人员土地权益问题研究

摘　　要：农村出身的体制内工作人员可能面临承包地被收回以及二轮延包资格丧失的可能性,这主要是因为农村出身的体制内工作人员收入优渥导致其不再需要土地的保障性功能,且他们的集体经济组织成员资格遭受质疑。农村出身的体制内工作人员具有特殊的身份属性和职业属性,且涉及的人员数量较多,如果不能妥善处理这类人员的土地权益问题,不仅可能形成反向激励,损害其土地合法权益,还可能导致土地资源的社会保障功能在城乡贫富人群之间的错配,进而影响共同富裕的实现以及社会和谐与稳定。故而,首先,在精细分类的基础上依法依规科学界定农村出身的体制内工作人员的集体成员资格;其次,保障农村出身的体制内工作人员在土地承包期内的土地权益不被收回或侵害;再次,妥善认定农村出身的体制内工作人员是否享有二轮延包资格;最后,完善土地退出机制,鼓励农村出身的体制内工作人员自愿有序退出承包地。Rural-origin employees in state-owned institutions may face the possibility of their contracted land being reclaimed and their eligibility for a second round of land contract extension being lost.This is mainly due to the high income of rural employees within the system,who no longer need the guarantee function of land,and their membership in collective economic organizations is questioned.Rural-origin employees in state institutions have distinct identities and occupational attributes,and involve a large number of personnel.If their land rights cannot be properly handled,it may not only create perverse incentives and damage their legal land entitlements but also lead to a mismatch of social security functions of land resources between urban and rural rich and poor populations,thereby affecting the realization of common prosperity and social harmony and stability.Therefore,firstly,it is essential to scientifically and legally define the collective membership status of rural-origin employees in state institutions based on a detailed classification.Second,their land rights during the contract period should be protected from being reclaimed or infringed upon.Third,it is necessary to properly determine whether rural-origin employees in state institutions are eligible for a second round of contract extension.Finally,we should improve the land withdrawal mechanism and encourage rural workers within the system to voluntarily and orderly withdraw from contracted land.
