摘　　要：在对华“去风险”战略的背景下,欧盟出台了一系列诸如《欧盟5G安全工具箱》“数字双法”等政策工具,其背后隐含着“战略—政策—工具”嵌套式的遏制逻辑。硬件领域欧盟以强硬的排他性手段将中国企业剔除供应链,软件领域则以加强监管、施加限制性义务及专项诉讼等手段遏制中国在欧企业的发展。当前在欧中国互联网企业面临经营成本增加,监管更加严格等问题,但由于欧盟的一系列政策在一定程度上也遏制了美国互联网巨头在欧的扩张,使得中国互联网企业拓展欧洲市场机遇与挑战并存。因此,应在国际舞台上倡导公平、开放的国际网络市场环境,引导相关企业做好合规性评估与风险管理,完善对欧盟不公制裁的反制手段。In the context of the de-risking strategy against China,the European Union has introduced a series of policy tools such as the EU 5G security Toolbox,the Digital Services Act and Digital Market Act,which implies the strategy-policy-tool nested containment logic.In the hardware sector,the EU employs strong exclusionary tactics to exclude Chinese firms from the supply chains.In the software sector,the EU has curbed the development of Chinese firms in Europe by tightening regulation,imposing restrictive obligations and targeted litigation.Chinese Internet companies in Europe are facing problems such as increased operating costs and stricter regulation,but the series of EU policies have also restrained the expansion of U.S.Internet giants in Europe to a certain extent,making the opportunities and challenges for Chinese Internet companies to expand the European market coexist.Therefore,China should advocate for a fair and open international network market environment in the international arena;guide relevant enterprises d in compliance assessment and risk management;and develop countermeasures against unfair EU sanctions.
