摘　　要：市场经济要求凡干预均需证成。反垄断法通过设定竞争损害要件来证成干预措施,其要件的证明方式就是垄断行为的分析模式,这也是反垄断法适用的核心环节。当下,我国反垄断执法和司法机关在反垄断分析模式的适用方面存在较为显著的分歧,造成反垄断规则层面缺乏一致性、标准方面缺乏统一性,导致实施结果层面的同案不同判。化解此问题的最佳方式就是对应用层面的分析模式本身进行改良,通过规律性探索厘定考量因素与结构规则,为反垄断法配置以结构型合理原则为基础、以综合考量为方式、以竞争效果为根本标准的系谱分析模式,形成规制效果由强到弱的多层次合理分析结构,确保准确性的同时最大程度保证效率,使之成为兼具针对性与普适性的类型化适用标准。The market economy requires all interventions to be proven.The Anti Monopoly Law establishes the elements of competition damage to prove intervention measures,and the proof of these elements is through the analysis model of monopolistic behavior,which is also the core link of the application of the anti monopoly law.At present,there are significant differences between China's anti⁃monopoly law enforcement and judicial authorities in the use of anti⁃monopoly analysis models,resulting in a lack of consistency in anti⁃monopoly rules and a lack of uniformity in standards,leading to different judgments on the same case at the implementation result level.The best way to solve this problem is to improve the analysis mode itself at the application level,explore and determine the factors and structural rules through regularity,and configure a genealogical analysis mode for antitrust law based on the principle of structural rationality,comprehensive consideration,and competition effect as the fundamental standard,forming a multi⁃level and reasonable analysis structure from strong to weak regulatory effects,ensuring accuracy while maximizing efficiency,Make it a typified and applicable standard that combines specificity and universality.
