版权史上的诚信原则及其当代价值

摘　　要：我国《著作权法》从未明文规定诚信原则,但版权诸领域与诚信原则有着千丝万缕的多维度联系。探寻历史印记,不论是西方私法诚信原则还是中国古代诚信思想都与版权观念高度契合。从罗马法到文艺复兴,再到19世纪图书国际贸易的繁荣发展,诚信原则广泛适用于西方逐渐构建起来的版权法律制度。相较而言,中国古代诚信思想所蕴含的版权保护观念也在丰富的文学艺术创作和有限的作品市场交易中得以体现。随着创作传播技术和文化生产环境的变革,诚信原则在当代版权实践中也展现出重要价值。在作品创作和版权取得方面,诚信原则具有正向引导价值,可以激励作者从事更富有想象力和创造力的创作活动。在版权交易方面,诚信原则具有保障交易安全和公平的价值;在版权保护和限制方面,诚信原则有效实现了版权人、使用者和社会公众的利益平衡。China's copyright Law has never clearly defined the principle of good faith,but the fields of copyright and the principle of good faith have a multidimensional connection.To explore the historical mark,both the principle of good faith in western private law and the thought of good faith in ancient China are highly consistent with the concept of copyright.From Roman law to the Renaissance to the prosperous development of the international trade of books in the 19th century,the principle of good faith is widely applied to the copyright legal system gradually constructed in the West.In contrast,the copyright protection concept of ancient Chinese honesty thought is also refiected in extensive literary and artistic creation and limited market transactions of works.With the change of creative communication technology and cultural production environment,the principle of good faith has shown its important value in contemporary copyright practice.In the aspects of creation and copyright acquisition,the principle of good faith has positive guiding value,which can encourage the author to engage in more imaginative and creative activities;In copyright transactions,the principle of good faith has the value of ensuring the safety and fairness of transactions;In terms of copyright protection and restriction,the principle of good faith effectively coordinates the relationship between the use of data resources and copyright protection.
