从食品安全标准角度释解标准的法律定位与制度边界

摘　　要：在标准的法律问题研究中,强制性标准的法律属性是一个争议性话题。既有的探讨从法律规范、法律规则抑或规范性文件等视角出发,通过各类构成要件在标准形成和作用中的比对,论证强制性标准的法律定性以及在行政和司法中的规范作用。然而,实务依然面对标准作为技术规范与法律规范的冲突困境。本文从标准自身的规范性和其在法律中的不同作用角度指出:标准体系中政府和市场的边界以及技术与法律的功能混淆导致了标准法律属性定位的内生困境。因而,对于以技术规范为内容的标准而言,其法律属性的界定首要在于标准体系架构的合理性,包括对于公私标准、技术标准和技术法规的不同分类。Objective:In the study of legal issues of standards,the legal attributes of mandatory standards is a controversial subject matter.From the perspective of legal norms,legal rules or normative documents,existing discussions have argued the legal characterization of mandatory standards and their normative role in administration and justice through the comparison of various constituent elements in the formation and role of standards.However,the practice is still faced with the conflict dilemma caused by the role of standards as technical norms and legal norms at the same time.By discussing the normative nature of the standard and its different roles in law,this paper points out that the confusion regarding the boundary between government and market as well as the functions of technology and law in the standard system has led to the endogenous dilemma of clarifying the legal attributes and status of the standard.Therefore,the definition of the legal attributes of standards with technical normative contents lies first and foremost in the rationality of the structure of the standards system,including the different categorizations of public and private standards,as well as technical standards and technical regulations.
