女性涉毒罪犯的限制性威慑——以J省某女子监狱的样本为例

摘　　要：通过研究犯罪人在实施犯罪过程中会采取何种策略来降低被侦查发现的概率以及减弱被捕后的惩罚后果,可以观察刑罚威慑如何被感知和应对。本文基于对J省某女子监狱62名毒品罪犯的问卷调查和对其中9名罪犯的深度访谈,分析发现女性毒品罪犯会采用交易对象限定、惯例遵守和失败改进策略以躲避侦查,采用毒品抛弃、保护利用和角色弱化策略以减轻惩罚后果,最终实现犯罪利益最大化。这种来自于实施毒品犯罪行为“局内人”的视角有助于揭示毒品犯罪女犯的决策机制,并为完善我国现有的毒品防控策略体系提供参考。How deterrence is perceived and responded to can be observed by examining the strategies an individual adopts when committing an offence and after being arrested.Based on the analysis of questionnaires collected from 62 drug offenders and in-depth interviews with 9 offenders in a women's prison in Province J,this paper finds that female drug offenders adopt different strategies to avoid detection and mitigate the punishment.Thereby,the risk of drug offending could to different degrees be under control.In doing so,they managed the risk of drug offending to varying degrees.This“insider”perspective on drug-related crime helps to reveal the decision-making mechanisms of female drug offenders and to reflect on and improve China's existing drug prevention and control systems.
