生态惠益价值嵌入环境刑事司法裁判结构的正义考量

摘　　要：污染环境犯罪案件仅依据前置法确认刑法所保护的法益与社会公众对生态正义的朴素期待相悖。污染环境违法犯罪行为认定的扩张与限缩,以及生态法益损害程度的判定,是否应当受前置法所形成的法律结构制约,对于污染环境犯罪案件刑事司法裁判至关重要。鉴于此,污染环境犯罪案件刑事司法裁判应当重视生态修复和损害预防,宽严相济,以恢复性司法理念提升治罪质效,释明生态惠益价值与环境公共利益的法律表达,以此回归环境刑事司法的生态本位,揭示生态惠益价值评估嵌入司法裁判结构的过程机理。行政行为中针对生态惠益价值的剖析,是对污染环境犯罪事实认定中刑法规范价值的补解,进而更好地实现环境司法专门化中生态正义与司法正义统合的良法善治,落实依法治污的中国式环境治理现代化理念。The adjudication of environmental pollution crimes solely based on the confirmation of legal interests protected by criminal law,as stipulated by preceding laws,contradicts the public's inherent expectations of ecological justice.The expansion and restriction of the recognition of environmental pollution offenses,as well as the determination of the extent of ecological harm,are crucially influenced by the legal structure formed by preceding laws.Therefore,it is imperative for the criminal judicial adjudication of environmental pollution cases to emphasize ecological restoration and damage prevention,balancing leniency and severity.By adopting a restorative justice approach,the quality and efficiency of criminal punishment can be enhanced,elucidating the legal expression of ecological benefit value and environmental public interest.This approach realigns environmental criminal justice with its ecological basis and reveals the procedural mechanisms through which ecological benefit value assessments are integrated into judicial adjudication structures.The analysis of ecological benefit value within administrative actions supplements the normative value of criminal law in the factual determination of environmental pollution crimes,thereby better achieving the integration of ecological justice and judicial justice within specialized environmental adjudication,promoting the rule of law and good governance,implement the modernization concept of environmental governance in accordance with the law in China.
