摘 要:公共工程招投标领域领导干部腐败行为具体有规避招标、串通投标、量身招标、操纵评标过程和推翻评标结果等表现形式。公共工程招投标制度安排尚不完善、招投标领域领导干部权力高度集中以及相应的监督机制尚不健全是导致或引发领导干部腐败行为发生的制度原因。有效治理公共工程招投标领域领导干部的腐败行为,应当从完善法律规范、加强监管监督、严厉惩戒追责三个维度出发,建立健全领导干部“不想腐、不能腐、不敢腐”的长效机制。Corruption of leading cadres in the field of public projects bidding and tendering takes such specific forms as bid evasion,collusive bidding,tailor-made bidding,manipulation of the bid evaluation process and overturning of bid evaluation results.The imperfections in the institutional arrangements of the public projects bidding system,the highly concentrated power held by leading cadres within the bidding domain,and the yet-to-be-perfected corresponding supervision mechanisms are the root institutional causes that give rise to or trigger the emergence of corrupt practices among leading cadres in the field of public projects bidding.Effective governance of the corruption of leading cadres in the field of public projects bidding and tendering should start with the three dimensions of perfecting legal norms,strengthening supervision and oversight,and imposing severe punishments,so as to establish and improve the long-term mechanism for leading cadres to“be unwilling to,be unable to,and dare not engage in corruption”.
