摘　　要：文章基于当下闲置宅基地退出的背景与现状,以古村落中历史建筑保护这一特定视角为切入点,聚焦退出效果不佳的情况,梳理发现当下两种法定路径存在的问题:宅基地收回“虚置”和宅基地征收“失灵”。按照征收权向宅基地上房屋拓展运用的思路,揭示出宅基地上房屋征收优化逻辑,并提出三种宅基地退出路径:宅基地征收、宅基地收回和宅基地上房屋征收;并对宅基地上房屋征收路径、宅基地征收路径、宅基地收回路径等相关立法完善涉及的核心问题进行探讨。Based on the background and current situation of the idle homestead exit,this paper takes the protection of historical buildings in ancient villages as the breakthrough point,focuses on the situation of poor exit effect,sorts out the problems existing in the current two legal paths:the"void"of homestead recovery and the"failure"of homestead collection.According to the idea of expanding the application of expropriation right to the houses on the homestead,this paper reveals the optimization logic of houses expropriation on the homestead,and puts forward three exit paths of the homestead:the homestead expropriation,the homestead repossession and the house expropriation on homestead,and discusses the core issues involved in the improvement of relevant legislation,such as the path of house expropriation on homestead,the path of homestead expropriation and the path of homestead recovery.
