新业态从业人员的工伤保障研究及展望

摘　　要：新业态从业者在工作过程中面临较高的职业伤害风险,但现有的工伤保险和商业保险却存在诸多局限,没有为其提供有效的保护。学界针对这一问题提出两种解决思路:一是将新业态从业人员直接纳入现有的工伤保险体系;二是建立一个独立的职业伤害保障体系,专门用于解决新业态从业人员的特定需求。尽管学界已经提出了一些措施和建议,但这些方案仍需进一步研究和完善。The literature indicates that workers in new business models face higher risks of occupational injuries during their work processes,but existing work injury insurance and commercial insurance have numerous limitations and fail to provide effective protection for them.Scholars have proposed two solutions to this problem:first,to directly include workers in new business models into the existing work injury insurance system;second,to establish an independent occupational injury protection system specifically tailored to the unique needs of workers in new business models.Although some measures and suggestions have been proposed,these solutions still require further research and refinement.
