摘 要:我国已有49个地区开展了长期护理保险试点,但仅有部分法律对其作出倡导性规定,故长期护理保险仍处于虽有规范性文件来引导,然而具可操作性的法律规定却缺位的状态,故各地相应实践中存在参保人员不具全民性、保障范围不具周延性、资金筹集渠道不具独立性且筹集门槛较低等问题;《医疗保障法(草案)》须由总结地方可示范可推广经验而对长期护理保险作出细化规定,统一参保对象、拓展保障范围、建立独立可持续的筹资渠道,以法律制度来推动长期护理保险的规范发展。In China,49 regions have carried out long-term care insurance pilots,but only some laws have made advocacy provisions on it,so long-term care insurance is still guided by normative documents and has no operational legal provisions.Therefore,in the corresponding practice,there exist problems that the insured personnel are not universal,the scope of protection is not circular,the fund raising channel is not independent and the threshold of fund raising is low.The Medical Security Law(Draft)should make detailed provisions on long-term care insurance by summarizing the experiences of local demonstration and promotion,unify the insured objects,expand the scope of protection,establish independent and sustainable financing channels,and promote the standardized development of long-term care insurance with the legal system.
