论监察“禁闭”措施的功能定位与规范适用

摘　　要：监察人员作为专责行使监察权的主体,理应受到更严格的监督。《监察法》第64条新增监察禁闭作为专门适用于监察人员的强制措施,具备对特定人员的人身强制性和临时羁押性。从价值维度分析,监察禁闭在体系上完善了监察强制措施,规定了对监察人员调查的特殊强制措施,体现了刀刃向内的自我革命战略思想。为保障禁闭措施在实践中准确适用,应明确适用对象具备的特殊性、适用标准兼具“实质性+程序性”的前置性条件,并加强适用期间被禁闭人的人权保障,以期发挥禁闭措施的最大效益。Supervision is unrestricted,and any power is subject to supervision.As legal subjects specializing in the exercise of State supervisory power,supervisory personnel should be subject to stricter supervision.Article 62 of the Draft Amendment to the Supervision Law adds the measure of supervisory confinement as a compulsory measure specifically applicable to supervisory personnel,with personal compulsion and temporary detention for specific personnel.In terms of value dimension,the supervision confinement measure has systematically improved the system of supervision compulsory measures,and procedurally stipulated the special compulsory measures for the investigation of the supervision personnel,reflecting the self-revolutionary thought of turning the knife blade inward.In order to ensure the accurate application of confinement measure in practice,it should be made clear that the targets of application have special characteristics,that the criteria for application have both"substantive and procedural"prerequisites,and that human rights protection for those confined during the period of application should be strengthened,in order to maximize the effectiveness of the confinement measure and advance the continued and in-depth reform of the State supervision system.
