摘 要:我国反垄断历经弱监管向强监管,再至常态化监管的历程。数智科技在政府监管当中的广泛应用为反垄断常态化监管的技术赋能提供了可能与契机。在监管前,数智技术的赋能侧重于风险预防;在监管中,追求经济分析的客观精准;在监管后,着重反垄断的执法追踪与效果评估。但数据、算法等新兴要素和技术本身的局限亦可能为反垄断常态化监管带来法治风险,在实体上,算法存在的先验性偏置与数据蕴含的多重价值可能为公权力的不当扩张提供“支持理由”;在程序上,技术的“黑箱”特质以及自动化反馈危及反垄断监管应遵循的正当程序。为此,需要明确数智技术赋能反垄断常态化监管的辅助地位,回归反垄断的经济理性,对算法设计和数据获取做出限制保障实体公正,坚守反垄断监管的正当程序实现程序正义。China's anti-monopoly has experienced a process from weak supervision to strong supervision,and then to normal supervision.The wide application of digital intelligence technology in government supervision provides the possibility and opportunity for the technical empowerment of regularized anti-monopoly supervision.Digital intelligence technology plays a role in risk prevention in the pre regulation stage,objective and accurate economic analysis in the regulatory stage,and tracking and evaluating the effects of anti-monopoly law enforcement in the post regulatory stage.However,the limitations of emerging elements and technologies such as data and algorithms can also bring rule of law risks to the regular anti-monopoly supervision.However,data,algorithms and other emerging elements and the limitations of the technology itself may also bring rule of law risks to the regular anti-monopoly supervision.In terms of entities,the priori bias of algorithms and the multiple values of data may provide"supporting reasons"for the improper expansion of public power;in terms of procedures,the"black box"qualities of the technology and automated feedback threaten the due process that should be followed in anti-monopoly supervision.Therefore,it is necessary to clarify the auxiliary status of digital intelligence technology to enable regular anti-monopoly supervision,return to the economic rationality of anti-monopoly,restrict algorithm design and data acquisition to ensure entity justice,and adhere to the due process of anti-monopoly to achieve procedural justice.
