摘　　要：在突发公共事件背景下,行政裁量权的规范运行是行政行为具备正当性的前提条件,对政府公信力的提升发挥着关键作用。应急行政裁量权运行不当易出现形式化执法、选择性执法及扩张性执法的问题,严重影响突发事件中的法治政府建设。“科层式”的管理结构、政策的导向作用、同理心正义的缺失是引发上述问题的主要原因。因而需要坚持以构建应急行政裁量说理公开制度为基础、以形塑比例原则思维为依托、以融入同理心正义为补充。规范应急行政裁量权的行使,让人民群众在每一个执法决定中都感受到公平正义,增益于法治政府建设。In the context of public emergencies,the standardized operation of administrative discretion is a prerequisite for the legitimacy of administrative acts,and plays a key role in improving the credibility of the government.The improper operation of emergency administrative discretion is prone to the problems of formal law enforcement,selective law enforcement,and expansive law enforcement,which seriously hinders the construction of a rule of law government in emergencies.The main reasons for the above problems are the"bureaucratic"management structure,the guiding role of policies,and the lack of empathy and justice.Therefore,it is necessary to adhere to the construction of an open system of emergency administrative discretion and reasoning,based on the principle of proportionality,and supplemented by the integration of empathy and justice.Regulating the exercise of emergency administrative discretion and making the people feel fairness and justice in every law enforcement decision is the gist of the construction of a rule of law government.
