摘　　要：个人信息和刑事司法数据的界分一直不明确,导致对两者的保护规则并不清晰。当前,我国虽已构建了一套较为完善的个人信息保护规则体系,但刑事司法数据安全保障仍呈现出附属、分散的样态。从法律保护视角下审视,刑事司法数据安全的保障未得到应有的重视。深入分析两者的内在价值,发现个人信息和刑事司法数据在不同维度具有大不相同的独特价值和重要性。进一步辨析两者的法律保护,可以发现既存在共通之处,也存在显著的差异。基于此,提出构建个人信息保护与刑事司法数据安全保障区分治理的初步框架,旨在为两者的法律保护提供更加明确和有效的指导。同时,也为《刑事诉讼法》的修改提供相应的参考,以期在法律实践中更好地平衡个人信息保护与刑事司法数据安全保障之间的关系。The demarcation between personal information and criminal justice data has been indefinite,resulting in unclear rules for the protection of both.At present,although a relatively perfect system of rules for the protection of personal information has been constructed in China,the safeguard of criminal justice data security still presents a subsidiary and decentralized pattern.Examined from the perspective of legal protection,the guarantee of criminal justice data security has not received due attention.In-depth analysis of the intrinsic value of personal information and criminal justice data would reveal that they have very distinguished unique values and importance in different dimensions.And further analyzing the legal protection of personal information and criminal justice data,it can be found that there are both commonalities and significant differences.Based on this,a preliminary framework is proposed for the construction of a differentiated governance of personal information protection and criminal justice data safety and security,aiming to provide clearer and more effective guidance for the legal protection of both.At the same time,this paper also provides a corresponding reference for the revision of the Criminal Procedure Law,with a view to better balancing the relationship between personal information protection and criminal justice data security in legal practice.
