法治新闻报道失范的话语互动研究

摘　　要：作为新闻话语的一种重要类型,法治新闻报道是由新闻话语和法治话语互动生成的一种话语杂糅,在我国法治现代化进程中起着非常重要的作用。本文以话语互动理论为基础,采用“双层—五步”话语互动分析框架,对法治新闻报道中的失范现象进行了探究,概括了其语言使用失范的主要现象,并阐释了造成语言使用失范的社会因素。研究发现,法治新闻报道失范主要源自新闻话语与法治话语的互动失序,在语言使用层面主要体现为法律术语使用不当、法律知识误用、案件信息不当披露和语言表述过度娱乐化。我国法治新闻报道中的语言失范现象主要由新闻机构和法制机构主体间权力关系界定不清晰、新闻工作者对新闻报道语境要素认知不足和新闻传媒的过度市场化造成。As an important type of news discourse that plays a crucial role in China’s legal modernization,legal news reports show a distinct feature of discourse hybridity,which can be regarded as the result of the discursive interaction between news discourse and legal discourse.Based on the theory of discursive interaction and by following the“two-level fivestep”analytical framework,this paper conducts a study on the anomie in China’s legal news reports,summarizing the phenomena of anomie on the linguistic level and interpreting the underlying social factors that may contribute to the anomie.It has been found that the anomie in China’s legal news reports mainly results from the disorder of the interaction between news discourse and legal discourse,which,on the linguistic level,manifests as misuse of legal terms,misapplication of legal knowledge,improper disclosure of case information,and excessive infotainment of linguistic expressions.It has also been found that the anomie in legal news reports can be attributed to the social factors of unclear definition of the power relation between news agencies and legal institutions,journalists’inadequate cognition of the contextual factors of news production,and excessive marketization of the media industry.
