走私濒危物种及其制品犯罪防治的困境与突破

摘　　要：中国式现代化是人与自然和谐共生的现代化,因而我国近年来日益注重在发展经济的同时保护生态环境和生物多样性。而与此同时我国也仍然频繁发生走私濒危物种及其制品的犯罪案件,且呈现出新的上升态势,相关部门在防治过程中面临着犯罪预防工作力度较弱、“三权”衔接机制运行不畅、犯罪成本收益比失衡的困境。鉴于此,侦查机关应该坚持问题导向,加强走私犯罪侦查工作的预测性、推动“三权”衔接规范化、加大走私犯罪成本,强化走私濒危物种及其制品犯罪的防治。Chinese path to modernization is the modernization of harmonious coexistence between man and nature.Therefore,in recent years,China has increasingly focused on ecological protection and biodiversity protection while developing economy.At the same time,there are stll frequent criminal cases of smuggling endangered species and their products in China,and they are showing a new upward trend.Relevant departments are facing the dilemma of weak crime prevention efforts,poor operation of the"three powers"linkage mechanism,and imbalanced cost-benefit ratio in the prevention and control process.In view of this,investigative agencies should adhere to a problem-oriented approach,strengthen the predictability of smuggling crime investigation work,promote the standardization of the"three powers"linkage,increase the cost of smuggling crimes,and strengthen the prevention and control of smuggling of endangered species and their products crimes.
