粤港澳大湾区走私犯罪治理现状考察及对策建议

摘　　要：在粤港澳大湾区建设步入提档升级、纵深推进的关键阶段,湾区内走私犯罪案件数量和涉案金额呈现出上升趋势,走私犯罪形式多样化,涉案物品种类复杂化,犯罪手段专业化、智能化,严重影响区域内经济高质量发展进程,甚至影响国家经济安全。然而,因粤港澳三地法律制度存在差异,水上侦查执法规范不足和反走私保障机制尚不完善,当前粤港澳大湾区走私犯罪治理存在犯罪溯源治理难、犯罪侦查打击难、犯罪综合治理难的困境。鉴于此,应当把握走私犯罪治理规律,进一步加强粤港澳三地协同合作,构建三地走私犯罪协同治理机制,同时不断完善制度保障,建立多部门参与的立体化走私犯罪治理体系,打造信息化、智能化的走私犯罪治理模式,为粤港澳大湾区建设营造良好环境。As Guangdong-Hong Kong-Macao Greater Bay Area enters a critical stage of upgrading and deepening its development,the number of smuggling crime cases and the amount of money involved in the Bay Area have shown an upward trend.The forms of smuggling crimes have diversified,the types of goods involved have become more complex,and the criminal methods have become more professional and intelligent,seriously affecting the process of high-quality economic development in the region and even threatening national economic security.However,due to differences in legal systems between Guangdong,Hong Kong,and Macao,inadequate norms for maritime investigation and law enforcement,and imperfect anti-smuggling safeguard mechanisms,the current governance of smuggling crimes in Guangdong-Hong Kong-Macao Greater Bay Area faces difficulties in tracing the origin of crimes,investigating and cracking down on crimes,and comprehensively managing crimes.In view of this,it is necessary to grasp the patterns of smuggling crime governance,further strengthen cooperation among Guangdong,Hong Kong region,and Macao region,and establish a collaborative governance mechanism for smuggling crimes across the three regions.At the same time,it is important to continuously improve institutional safeguards,establish a multi-dimensional smuggling crime governance system involving multiple departments,and create an informational and intelligent smuggling crime governance model,in order to foster a favorable environment for the development of Guangdong-Hong Kong-Macao Greater Bay Area.
