摘　　要：以教喻为主导的调解话语劝服式修辞模式往往将解纷与空间、场景、情境抽离出来,这种固化的方法习惯使当事人的个体差异和特殊需求难以兼顾、忽视情绪情感需求、引发抵触心理,使得调解往往流于表面或走向纠纷解决合意的压制,难以适应日益复杂的社会矛盾纠纷。调解方法的空间、场景、情境新修辞学赋能是促进调解能力现代化,提升解纷效能,突围既往调解范式实践僵局的新视角。新修辞赋能调解能力现代化要从以下六个方面出发:提高调解主体运用新修辞开展调解活动能力;推动新修辞赋能调解模式在地化发展;完善空间、场景、情境转换的程序衔接机制;坚持创新驱动,建立数字新修辞赋能调解机制;推动新修辞赋能调解的理论创新和学术体系建构;加强宣传引导,扩大新修辞赋能调解的影响力。The persuasion rhetoric model for the admonishment-oriented mediation discourse tends to detach dispute mediation from space,settings and situation.Such an entrenched method or habitus is deficient in that the clients can hardly balance individual differences and special demands,the emotional and feelings demands are neglected,and the mentality of non-responsiveness can occur.Consequently,mediation could take place superficially,or the dispute solution agreement could be suppressed,and therefore the increasingly complex social disputes can be hardly addressed.The enabling of new rhetoric in terms of space,settings and situation of mediation methods is a new perspective for promoting the modernization of mediation abilities,improving the efficacy of dispute solution,and breaking away from the dilemma of established mediation paradigm practice.The modernization of mediation abilities through the enabling of new rhetoric starts in six ways:improving the subject′s abilities of using new rhetoric to carry out mediation activities;promoting the localization of mediation model enabled by new rhetoric;enhancing the procedural cohesion mechanism for space,settings and situation transformation;abiding by innovative driving and establishing a mediation mechanism through the digital enabling of new rhetoric;advancing the theoretical innovation and the academic system construction for mediation enabled by new rhetoric;strengthening publicity and guidance,and expanding the influence of mediation through the enabling of new rhetoric.
