数字平台编辑自由的法律控制——基于《电子商务法》第39条规定的阐释

摘　　要：数字平台常以行使编辑自由为由剥夺和限制消费者的评价资格,不当删除,屏蔽、操纵评价信息,乃至对抗政府管制,给消费者评价权的实现带来了严峻挑战。立法的消极放任模式已无法有效回应,给数字平台设定非歧视义务的积极干预模式更符合实践需求。然而,积极干预模式的正当性如何?既有公共承运人理论、公共场所理论仅能提供外在必要性的解释,尚需在宪法框架下解释法律干预的内在正当性。数字平台提供的表达性产品并不能直接反映其观点,非歧视义务的设定并不会不当限制数字平台的编辑自由。数字平台以营利形式从国家建立和维护的公共市场中获利,获得对消费者评价的管理权、责任豁免等对价,编辑自由的行使不易受干扰和承受不当负担。Digital platforms often deprive and restrict consumers\review qualifications on the grounds of exercising editorial freedom.Moreover,they improperly delete,shield and manipulate review information,and even resist government regulation,which brings severe challenges to the realization of consumers\review right.The passive laissez-faire model of legislation is no longer an effective response.The positive intervention model that creates non-discrimination obligations for digital platforms is more in line with practical needs.However,what is the legitimacy of the positive intervention model?The established common carrier doctrine and public accommodations doctrine can only provide an explanation of the external necessity,but the internal legitimacy of legal intervention needs to be explained under the constitutional framework.The expressive products offered by digital platforms do not directly reflect their views,and the imposition of non-discrimination obligations does not unduly restrict the editorial freedom of digital platforms.Digital platforms profit on a for-profit basis from public markets established and maintained by the state,obtaining the right to manage consumer review,liability exemption and other considerations,and their exercise of editorial freedom is not easy to be interfered with on bear undue burdens.
