健全羁押人员表现考核对接机制的难点研究——以S市看守所羁押人员交付监狱执行后羁押表现考核对接的调查分析为视角

摘　　要：对罪犯“计分考核”是目前调动罪犯改造积极性的基本手段,也是衡量罪犯改造质量的基本尺度。S市15个看守所与10个监狱的调查数据显示,因投监不及时、久押不决等原因,造成大量在看守所长期羁押的罪犯;又因这些罪犯的表现考核不能及时有效对接监狱考核机制,使得计分考核制度未能充分发挥应有的作用,带来了诸如监管压力持续增加、罪犯合法权益无法得到有效保障等实际问题。通过提升相关规定的法律位阶、补充制度漏洞、强化检察监督等方式,可以有效推进考核对接机制的构建,对刑事执行工作高质量发展有所裨益。The“scoring assessment”for criminals is currently the basic means to mobilize the enthusiasm of criminals for reform,and also the basic scale to measure the quality of criminal reform.Survey data from 15 detention centers and 10 prisons in S City shows that a large number of criminals are detained in detention centers for a long time due to reasons such as untimely imprisonment and long-term detention without decision;and because the performance assessment of these criminals cannot be timely and effectively connected to the prison assessment mechanism,the scoring assessment system has failed to fully play its due role,resulting in practical problems such as the continuous increase in supervision pressure and the inability to effectively protect the legitimate rights and interests of criminals.It can effectively promote the construction of assessment docking mechanism and benefit the high-quality development of criminal execution work by improving the legal status of relevant regulations,supplementing system loopholes and strengthening procuratorial supervision.
