摘　　要：知识产权的地域性决定了有关版权的国际私法适用规则会产生不同的立场和纷争。当前网络环境下,传播方式的变革推动了涉外版权的发展,而司法实践中对涉外版权侵权行为的界定还比较模糊。结合涉外版权侵权法律适用规则的司法实践现状,选取代表性的法律适用规则选择模式作为研究对象,分析这些模式的属性和优势,指出不同国家法律在解决涉外版权侵权行为方面的思路,以期为我国优化涉外版权侵权法律适用规则提供借鉴。The regional nature of intellectual property rights causes various interpretations and disputes over the applicable rules of private international law regarding copyrights.The evolution of communication through networks has facilitated the growth of foreign copyrights.However,the definition of infringement upon foreign copyrights in judicial practice remains indistinct.Given this,this paper examines various representative selection modes of legal application rules and analyzes their attributes and advantages,highlighting how different countries address the issue of foreign copyright infringement by law,in the hope of providing insights that could help improve the application rules in China.
