摘 要:数字化转型和直播行业的兴起不仅为录音制品的二次使用提供新的应用场景,也为录音制品获酬的实际需求带来新挑战。文章通过对录音制品获酬权的权利性质、权利主体和适用范围等问题的解构,进一步明确权利适用、流转与救济等适用规则。基于直播的特殊性,集体管理机制在获酬权的实现上具有不可或缺的作用,但我国现有集体管理制度失灵,需围绕私人自治理念进行制度优化,包括取消专属许可、引入营利性集体管理组织等。同时,在新型集体管理模式基础上,应推动构建统一数据库、多样化许可体系与争议解决机制,为直播领域录音制品获酬权的实现提供充分保障。The digital transformation and the rise of the live-streaming industry have introduced new application scenarios for the secondary use of sound recordings, while also posing significant challenges for ensuring fair remuneration. By deconstructing the nature, rights holders, and scope of remuneration rights for sound recordings, the applicable rules for transfer and remedies are clarified. Given the unique nature of live-streaming, collective management mechanisms play an indispensable role in realizing remuneration rights. However, the existing collective management system in China has shown inefficiencies, necessitating reform based on the principle of private autonomy, such as abolishing exclusive licensing and introducing profit-oriented collective management organizations. Building upon a new collective management model, efforts should be made to establish a unified copyright database,develop a diversified licensing system, and implement a dispute resolution mechanism to ensure the effective realization of remuneration rights for sound recordings in live-streaming contexts.
