林业碳汇融资担保的现实困境及应对策略

摘　　要：林业碳汇是应对气候变化的重要手段之一,但由于资金和市场需求不足,在京都议定书第一承诺期结束后似乎陷入了停滞不前的境地。参考各国发展历程,碳市场金融化是大势所趋。林业碳汇融资担保是林业碳汇交易市场金融化的第一步,通过林业碳汇融资担保活动可增加金融机构参与度,增强林业碳汇交易市场的流动性。文中首先指出,与传统担保相比,林业碳汇融资担保在担保目的、担保人责任、优先受偿权实现程序、权利履行时间方面存在特殊性;随后分析了目前林业碳汇融资担保面临的多重融资担保风险、法律基础薄弱、监管机制不健全等法律问题。在此基础上,提出以下建议:(1)完善林业碳汇融资担保的风险管理和配套制度;(2)加强政府引导和法律制度完善;(3)健全林业碳汇融资担保监管体制等应对路径。Forest sinks are one of the most important means of addressing climate change,but due to insufficient funds and market demand,it seems to have come to a standstill after the end of the first commitment period of the Kyoto Protocol.In view of the development history of various countries,the financialization of carbon market is a general irreversible trend,and the financing guarantee of forest sink is the first step to financialize the forest sink trading market,which could increase the active involvement of financial organizations and improve the liquidity of forest carbon market.The paper firstly points out that,compared with the traditional guarantee,financing guarantee for forest sinks show special characteristics in terms of the purpose,the responsibility of guarantor,the procedure of priority right of compensation,and the time of performance of right,and then analyses the legitimate problems that current forest sink financing guarantee is faced with,including the risk of multiple financing guarantee,weak legal basis,and unsound regulatory mechanism.On this basis,suggestions are proposed,which includes:(1)improving the risk management and supporting system of forest sinks financing guarantee;(2)strengthening the government guidance and legal system;and (3)improving the regulatory system of forest sinks financing guarantee.
