数据要素全国统一大市场的构建——以数据要素交易平台监管为切入点

摘　　要：数据要素全国统一大市场的构建对于推动我国经济高质量发展具有重要意义。目前,数据要素交易呈现质量低、层次低、风险高的趋势,其中数据要素交易平台发展的滞后是阻碍数据要素交易全国统一大市场形成的重要原因之一。该文分析了影响数据要素交易平台发展的因素,探讨了数据交易平台的法律属性,提出要从数据要素交易平台监管制度出发,从监管时间、力度、方式等方面完善数据要素交易制度,以期促进数据要素全国统一大市场的实现。The construction of a nationalunified market for data elements is of great significance for promoting the high-quality development of China's economy.Currently,data element transactions exhibit low quality,low levels,and high risks.Among these,the underdevelopment of data element trade platforms is one of the key rea sons hindering the formation of a nationalunified market for data element transactions.This paper analyzes the fac tors affecting the development of data element trade platforms,explores the legal attributes of data trade platforms,and proposes that improvements to the data element trading system should start with the regulatory framework of data element trade platforms.Specifically,it suggests enhancing the regulatory system in terms of timing,intensity,and methods to facilitate the realization of a nationalunified market for data elements.
