摘　　要：志愿服务参与环境治理,是推动环境治理模式和志愿服务现代化转型的内在要求和应有之义。作为一种集体行动,志愿服务参与环境治理需要诸多逻辑因素共同发挥作用才能避免陷入“行动困境”。从行为逻辑上看,志愿服务群体积极、持续地参与离不开主体意识的驱动、价值理性的引导及伙伴关系的协同。从制度逻辑上看,志愿服务群体规范、有序地参与仰赖于政策工具的适度运用、制度规则的事前安排、信息交互机制的创新完善,以及赋权与责任对等原则的充分贯彻。法治是实现志愿服务参与环境治理的行为与制度逻辑统合的重要手段。通过以法律规则与公共政策为中心的形式合法性建构、以程序设计为重点的过程建构、以责任配置为基础的实质有效性建构、以激励培育为导向的行动模式建构,推动志愿服务参与环境治理的法治化进程,为促进志愿服务更有效地嵌入环境共治网络,形成善治的参与秩序奠定坚实的法治基础。Volunteer service participation in environmental governance is an inherent requirement and necessary aspect of advancing the transformation of environmental governance models and modernizing volunteer services.As a form of collective action,volunteer service participation in environmental governance requires multiple logical factors to work together in order to avoid falling into the“action dilemma”.From a behavioural logic perspective,the active,and sustained involvement of volunteer groups depends on the driving force of subject consciousness,guidance by value rationality,and collaboration through partnerships.From an institutional logic perspective,the organized and orderly participation of volunteer groups relies on the appropriate use of policy tools,pre-arranged institutional rules,innovative and improved information exchange mechanisms,and the full implementation of principles of equivalence between empowerment and responsibility.The rule of law is a crucial means of integrating the behavioural and institutional logics of volunteer service participation in environmental governance.By constructing legal legitimacy cantered on laws,rules and public policy,process construction focused on procedural design,substantive effectiveness based on responsibility allocation,and action models guided by incentives and cultivation,the legal process of volunteer service participation in environmental governance can be promoted.This helps embed volunteer services more effectively into the environmental co-governance network,thereby laying a solid legal foundation for the formation of good governance participation orders.
