摘　　要：公务员养老金待遇处分是全面从严治党的必然要求,其蕴含着“赏功罚过”的优抚理念,该制度的法律依据、处分内容和幅度、处分机关、程序以及救济不明确。随着全面依法治国的推进,基于我国公务员养老保障水平较高的现实,借鉴养老金待遇处分制度的比较经验,《公职人员政务处分法》等应明确将“降低或取消退休待遇”作为政务处分类型,其原则上适用于在职期间的违法行为,且仅降低或取消基本养老金之外的职业年金和以贡献补偿为目的的待遇,监察机关或任免机关做出处分决定后,书面通知包括社保经办部门在内的待遇给付单位落实,对处分决定不服的,可提起诉讼。The disciplinary scheme for civil servants'pension benefits is an essential requirement for the comprehensive and stringent governance of the Party.It embodies the concept of"rewarding merits and punishing faults."However,this system lacks clarity in several areas,including its legal basis,the scope and nature of the disciplinary actions,the competent authorities,procedural guidelines,and avenues for redress.With the ongoing implementation of the rule of law,and considering the relatively high level of pension benefits for civil servants in China,comparative legal experience suggests that laws such as the Civil Servants Disciplinary Law should explicitly include"reducing or canceling retirement benefits"as a form of administrative punishment.This disciplinary measure should,in principle,apply to unlawful conduct during the individual's tenure and should be limited to the reduction or cancellation of supplementary pensions and other benefits aimed at compensating for contributions,excluding the basic pension.After the disciplinary body,such as the supervisory or appointing authority,makes a decision,it should notify the relevant institutions,including social security agencies,in writing to enforce the penalty.Those who disagree with the disciplinary decision may appeal through legal proceedings.
