摘  要:专家论证是生态保护红线划定程序中的法定环节和基本制度,能够借助科学权威增强划定成果的法律效力。实践中生态保护红线专家论证存在过度依附行政机关、缺乏外部监督、工作自主性不强、论证程序不规范等问题。需要以法治化路径完善生态保护红线专家论证制度。应提高立法层级以补全法律规范,明确专家论证相对行政机关而言独立的法律地位,为专家成员提供完备的权利保障,强化专家论证意见的法律效力,并作为划定成果合法性审查的重要依据。同时,应细化专家论证工作机制与规则设计,完善绩效考核、责任追究等配套制度建设。Expert evaluation is a statutory component and fundamental system in the process of delineating ecological protection redlines,which can enhance the legal effectiveness of the delineation results through scientific authority.In practice,there are several issues with expert evaluations for ecological protection red line,including excessive dependence on administrative agencies,lack of external supervision,insufficient autonomy in work,and non-standardized evaluation procedures.It is necessary to improve the expert evaluation system for ecological protection red line through a rule of law approach.Legislative levels should be elevated to complete legal norms,clarifying the independent legal status of expert evaluations relative to administrative agencies,providing comprehensive rights protection for expert members,and strengthening the legal effectiveness of expert opinions,as an important basis for the legitimacy review of delineation results.Additionally,the working mechanisms and rules for expert evaluations should be refined,and supporting systems such as performance assessment and accountability should be improved.
