摘  要:人工智能作为新一轮科技革命和产业变革的重要驱动力,正深刻改变着社会生产和生活方式。与人工智能有关的创作、艺术、发明、算法、大数据等问题具体表现为:人工智能创作物的客体范围界定模糊,主体资格认定制度缺失;精神权利制度在人工智能创作领域缺乏可适用的空间;权利取得方式及权利存续期间的认定滞后于社会发展的现实需求等。基于此,文章提出以下建议:应当明确人工智能创作物可以成为知识产权的客体;赋予人工智能创作物的设计者和实际操作者相应的权利主体资格;鉴于人工智能的非人类特性,应适当限制人工智能创作语境下著作者的精神权利;考虑到人工智能创作的高效性以及作品更新的快速性,有必要针对人工智能创作物的著作权建立强制登记制度,并适当缩短权利的存续期间。AI,as an important driving force for the new round of technological revolution and industrial transformation,is profoundly changing the way of production and life of society.Issues such as creation,art,invention,algorithm,big data and other issues related to AI are becoming increasingly prominent,which are specifically manifested as:the vague definition of the object scope of AI creations and the lack of a system for determining subject qualifications;The moral rights system is not applicable in AI creation;The recognition of the acquisition method and duration of rights lags behind the practical needs of social development.Based on this,the article proposes the following suggestions:firstly,it should be clarified that AI creations can become objects of intellectual property rights;Secondly,endow the designers and actual operators of AI with corresponding subject qualifications;Again,given the non-human nature of AI,the moral rights of authors in the context of AI creation should be appropriately restricted;Finally,considering the efficiency of AI creation and the speed of work updates,it is necessary to establish a mandatory registration system for copyright of AI creations and appropriately shorten the duration of rights.
