湖南省排污权交易与排污许可制度衔接探究

摘　　要：建立排污权有偿使用和交易(以下简称“排污权交易”)与排污许可制度是我国生态文明体制改革的重要举措,推进两项制度的有效衔接,是实现以排污许可为核心的管理模式的必然选择。本文立足湖南省生态环境管理实践,梳理了排污权交易与排污许可制度衔接探索中取得的经验,分析了两项制度在功能定位、管理范围、有效期限、登载方式、监管5个方面衔接面临的问题,并从“分权”界定功能定位、合理设定管理范围、加强“权”“证”动态管理、依托排污许可证监管及加强制度体系建设与协同方面提出了建议,旨在为以排污许可为核心的两项制度有效衔接提供参考与借鉴。The establishment of two systems for the paid use and trading of emission rights(hereinafter referred to as "emission trading") and the pollutant discharge permit is a critical measure in advancing China′s ecological civilization reform.Promoting the effective integration of these two systems is an essential step toward achieving a management model centered on pollutant discharge permits.Based on the practical experiences of ecological and environmental management in Hunan Province,this study reviews the achievements in integrating the emission trading system with the pollutant discharge permit system.It identifies key challenges in the areas of functional roles,management scope,validity period,publication methods,and regulatory frameworks.Based on this analysis,recommendations are provided,including clarifying functional roles through "decentralization",rationally defining management scopes,enhancing the dynamic management of "rights" and "permits",improving regulatory mechanisms based on pollutant discharge permits,and enhancing institutional system construction and coordination.This study aims to offer valuable insights and references for the effective integration of the two systems,with pollutant discharge permits serving as the central framework.
