中医药传统知识合理使用规则:价值意蕴、现实审视、路径完善

摘　　要：中医药传统知识是中医药传承发展的坚实底蕴。当前中医药传统知识缺乏合理的传播路径,这严重阻滞其继承与创新。通过法律的规范性指引,借鉴源自版权领域的合理使用规则可以为中医药传统知识架设一条理想的传播途径。中医药传统知识合理使用规则不仅具有平衡各方利益、推动人权保护及正义实现的理论价值,还兼具促进发展与创新、加快中医药繁荣演化的实践价值。然而该规则面临着体系不适配、立法模式存在弊端、引发各方利益失衡等现实困境。对此,具有工具理性的比例原则可作为权衡方法,推进中医药传统知识合理使用规则的完善。仿照“三步检验法”与场景化判断明晰中医药传统知识的合理使用应当以合理目的、合理方式与正当结果为审查基准。Traditional Chinese Medicine(TCM)knowledge is a solid foundation for the inheritance and development of Chinese medicine.At present,the traditional knowledge of Chinese medicine lacks a reasonable transmission path,which seriously hinders its inheritance and innovation.Through the normative guidance of the law,the fair use rules derived from the copyright field can set up an ideal way for the dissemination of traditional Chinese medicine knowledge.Rules for the rational use of traditional Chinese medicine knowledge not only have the theoretical value of balancing the interests of all parties,promoting the protection of human rights and the realization of justice,but also have the practical value of promoting development and innovation and accelerating the prosperity and evolution of traditional Chinese medicine.However,the rules are faced with the practical difficulties such as the system is not suitable,the legislative model has drawbacks,and the interests of all parties are unbalanced.In this regard,the principle of proportion with instrumental rationality can be used as a weighing method to promote the perfection of the rules of rational use of traditional Chinese medicine knowledge.According to the“three-step test”and scene judgment,the rational use of traditional Chinese medicine knowledge should be based on reasonable purpose,reasonable way and reasonable result.
