摘　　要：为全面评估《医疗纠纷预防和处理条例》5年来实施效果,采用典型抽样方法,设计针对医疗机构医务人员、卫生行政主管机关工作者、社会大众以及卫生法律专业人员的问卷,同时从全国7大区域选取10所医疗机构,对其医疗纠纷、赔偿、处理方式、医疗责任保险和医疗意外保险等方面的实施情况进行调研,共收回有效问卷31196份。调查结果显示,医疗纠纷预防和处理已逐步纳入法制化轨道,呈现出平稳有序、公正快捷和规范多元的特点。《医疗纠纷预防和处理条例》实施促进形成了医疗纠纷预防为主的理念和发展趋势,增强了医疗行业的法制意识,对医疗风险防范机制完善、医疗质量和服务水平提高、患者满意度提升和改善患者体验起到了积极作用,对减少医疗纠纷、缓解医患矛盾具有重要意义,为今后相关政策的制定提供了科学依据。To comprehensively assess the effectiveness of the Regulations on the Prevention and Handing of Medical Disputes over the past five years,a questionnaire survey was conducted using a stratified sampling method.The survey targeted medical institution personnel,health administration officials,the general public,and legal professionals specializing in healthcare law.Additionally,ten medical institutions were selected from seven major regions nationwide to examine the implementation of the regulation in terms of medical disputes,compensation,resolution methods,medical liability insurance,and medical accident insurance.A total of 31,196 valid questionnaires were collected.The results indicate that the Regulations on the Prevention and Handing of Medical Disputes have gradually become more legalized,characterized by stability,fairness,efficiency,and standardized diversity.The implementation of the regulation has fostered a preventive approach to medical disputes,strengthened the legal awareness of the healthcare industry,improved medical risk prevention mechanisms,enhanced medical quality and service levels,increased patient satisfaction,and positively impacted patient experience.Furthermore,it has played a crucial role in reducing medical disputes and alleviating doctor-patient tensions,providing a scientific basis for future policy development.
