摘　　要：《医疗纠纷预防和处理条例》颁布实施5年来,为医疗纠纷的处理提供了多元化的解决途径,医疗纠纷人民调解已成为纠纷处理的主渠道。但在医疗纠纷人民调解实践中,仍存在调解组织经费保障不稳定、调解队伍缺乏培养和发展机制、调解程序缺乏法律支撑、调解结果执行力欠缺和调解目的性不规范等问题。基于国家卫生健康委医疗应急司委托,中国医院协会医疗法制专业委员会课题组对目前医疗纠纷人民调解模式进行了分析研究,并针对这些问题进行深入探讨。在此基础上,提出强化政府在医疗纠纷调解中的主导作用、建立健全政府引导的调解制度、鼓励社会力量参与、完善地方立法以及加强宣传引导等改进措施,以期进一步完善医疗纠纷调解机制,促进医疗行业健康发展与社会和谐稳定。Since the implementation of the Regulations on the Prevention and Handing of Medical Disputes five years ago,multiple dispute resolution pathways have been established,with people’s mediation becoming the primary channel for handling medical disputes.However,challenges remain in practice,including unstable funding for mediation organizations,the lack of training and development mechanisms for mediators,insufficient legal support for mediation procedures,weak enforceability of mediation outcomes,and unclear mediation objectives.Entrusted by the Medical Emergency Department of the National Health Commission,the Medical Law Professional Committee of the Chinese Hospital Association conducted an in-depth study on the current people’s mediation model for medical disputes.Based on the findings,this study proposes measures to strengthen the government's leadership role in mediation,establish a sound government-led mediation system,encourage social participation,improve local legislation,and enhance public awareness and guidance.These improvements aim to further refine the medical dispute mediation mechanism,promote the healthy development of the healthcare industry,and maintain social harmony and stability.
