摘　　要：绿色条款进入《民法典》后经历了引入、冲突、协调三个阶段,目前正处于冲突与协调的过程中。为促进绿色条款的具体落实,应在《民法典》视角下对绿色条款进行系统分析。一方面,绿色条款契合民法传统的“权利-义务-保障”体系,体现为绿色物权、绿色义务和绿色侵权。另一方面,绿色条款与民法体系亦存在“公益-私益”冲突,体现为绿色物权的公私冲突,绿色义务的公益限制和绿色侵权的公私混同。为使绿色条款融入民法体系并适用,应从传统的公私冲突视角转变为公私协调视角,接纳绿色物权的公私融合,确定绿色义务的限制途径,进行绿色侵权的公私保障。After the entry of green clauses into the code,they have gone through three stages:introduction,conflict,and coordination,and are currently in the process of conflict and coordination.To promote the specific implementation of green provisions,a systematic analysis of green clauses should be conducted from the perspective of the Civil Code.On the one hand,green provisions are in line with the traditional“rights-obligations-guarantees”system of civil law,reflected in green property rights,green obligations,and green infringement.On the other hand,there is also a“public interest-private interest”conflict between green provisions and the civil law system,which is reflected in the public-private conflict of green property rights,the public interest restriction of green obligations,and the public-private confusion of green infringement.In order to integrate green provisions into the civil law system and apply them,the traditional perspective of public-private conflict should be transformed into a public-private coordination perspective,accepting the public-private integration of green property rights,determining the limiting channels of green obligations,and providing public-private protection for green infringement.
