公共数据开放利用的现状检视与机制完善

摘　　要：我国公共数据开放利用处在起步阶段,各地数据开放水平差异较大。公共数据开放不仅可以助力城市数字化转型,推动国家治理能力现代化,更蕴含了巨大的社会经济价值。当前公共数据开放利用机制主要存在数据高质量开放不够、高成效利用较少、供需双方权责不匹配的问题。需要通过提高开放力度、解决数据安全担忧以及明确开放内容来提高开放质量;通过赛事引导、挖掘需求以及探索成本补偿与收益分享机制来提高利用成效;通过拓宽数据侵权的救济渠道以及合理分配平台与用户之间的权责来解决供需双方权责不匹配的问题。用更完善的公共数据开放利用机制迎接数据开放浪潮。The current state of public data openness and utilization in China is at a nascent stage,with considerable discrepancies in the extent of data openness across various regions.The openness of public data not only facilitates the digital transformation of cities and enhances the modernization of the nation's governance capabilities,but also possesses substantial social and economic significance.Presently,the mechanisms for the public data openness and utilization are facing problems such as the insufficient openness of high-quality data,the deficiency in effective utilization of data,and the mismatch of rights and responsibilities between the data suppliers and data users.To address these problems,this paper underscores the imperative to elevate the quality of data openness by increasing the level of data openness,addressing concerns about data security,and clarifying the content of data openness.It also advocates for the enhancement of data utilization efficiency via competition-stimulated guidance,investigation of demands,and the examination of both cost compensation and benefit-sharing mechanisms,and makes suggestions on resolving the mismatch of rights and responsibilities between data-providing platforms and data users by broadening the relief channels for data-related infringements and reasonably allocating the rights and responsibilities between the two parties.Through such endeavors,more comprehensive mechanisms for the openness and utilization of public data can be established to embrace the tide of data openness.
