摘　　要：在全球化的“超领土化”趋势下,传统国际法实证主义方法显示出历史局限性,同时为中国国际法学界破除西方中心主义视角下的偏见提供了契机。文章借助社会系统理论在认识论和观察视角的洞见,以功能逻辑超越领土逻辑为目标,以“一般化和再具体化”方法为进路,对国际法实证主义方法的重要概念开展改造。社会系统理论的功能逻辑可重塑“独立”“平等”作为主权衍生的国家基本权利的基本内涵,明晰其在全球化时代的功能意涵。以社会系统理论的多元主义为棱镜,重新审视国际法和国内法的关系理论,确立以“关系性视角”超越传统的一元论、二元论所固有的领土逻辑局限。如此,将近年来中国制度型开放实践纳入经社会系统理论改造的概念框架中进行考察,可洞悉当今世界百年未有之大变局复杂环境下一种与功能逻辑紧密相连、更为深刻的中国开放观正日益成型。社会系统理论为中国国际法学界识别、参与国际法提供了另一种以“承认差异”为前提的合作式路径。Under the rise of“supraterritoriality”of globalization,the traditional positivist approach to international law has shown its historical limitations,and this provides an opportunity for the international law circle in China to break through the bias in the context of Western centralism.Based on the insights of the social systems theory in terms of both epistemology and observation,this article aims to reshape the important concepts of positivist approach to international law with a purpose of transcending the territorial logic with functional logic and by applying the methodology of“generalization and respecification”.The functional logic of the social systems theory can reshape the basic connotations of“independence”and“equality”,which are deemed as fundamental rights of a state derived from sovereignty so as to clarify their functional implications in the era of globalization.By reviewing the relationship between domestic and international laws with the pluralism of the social systems theory,it helps to transcend the inherent limitations of territorial logic in traditional monism or dualism with relational perspective.Therefore,to observe China's practices of institutional opening-up in recent years in the conceptual framework that is reshaped by the social systems theory,it helps to gain insightful understanding of the complicated environment featuring profound changes unseen in a century.As a result,it helps to gradually form a more profound opening-up approach that is closely linked to the functional logic.The systems theory provides an alternative approach featuring the recognition of differences for the international law circle in China to identify and engage in the international law.
