《档案法》评注编纂:功能定位与范式构想

摘　　要：尽管《档案法》在经过历次修订后,相较过去已日臻完备,但伴随国家现代化水平不断拔高,档案事业的发展步入纵深阶段,许多与《档案法》具有强关联性的法律不断涌现,导致涉及档案事业的诸多技术概念与规范用语也函需进一步改进、充实和解释。然而,短时间内再次启动《档案法》修订确实有违立法逻辑,并不可行。这导致了立法论的式微,需要解释论补足。法律评注以对现行法的解释技术为核心,是承担这一任务的必要载体,在如今亦不应缺席。它可以通过对《档案法》及其关联法律法规的重要内容和学理阐释的归纳提炼,为档案学界与实务界搭建桥梁,帮助消解档案法规范的适用困境,并更加精确地把握好《档案法》的完善路向。因此,需要在明确《档案法》评注编纂价值取向的基础上,对其进程、篇幅、体例、格式、内容和素材作出恰当闸释。Although the Archives Law has been gradually improved after previous amendments,with the continuous improvement of the country's modernization level and the in-depth development of the archives cause,many laws with strong relevance to the Archives Law have emerged,resulting in many technical concepts and standardized terms related to the archives cause that urgently need further improvement,enrichment,and interpretation.However,it is indeed contrary to the legislative logic and not feasible to restart the revision of the Archives Law in a short period of time.This has led to the decline of legislative theory and requires the complementation of interpretive theory.The legal commentary,which focuses on the interpretation technology of the current law,is a necessary carrier to undertake this task,and it should not be absent today.It can build a bridge between the archival academic and practical circles through summarizing and refining the important contents and theoretical explanations of the Archives Law and its related laws and regulations,helping to resolve the dilemma of applying the norms of the Archives Law and more accurately grasp the direction of improving the Archives Law.Therefore,it is necessary to make appropriate explanations on its process,length,style,format,content,and materials on the basis of clarifying the value orientation of compiling the commentary on the Archives Law.
