和合文化理念下民转刑案件防控对策探析

摘　　要：和合文化作为中华传统文化的精髓,倡导宽容礼让、互敬互谅、和谐共生的处事理念,对于防范民间纠纷激化为刑事案件具有重要的理论与应用价值。执法司法实践证明,背离和合文化理念的处事方式是导致诸多民转刑案件悲剧发生的深层次诱发因素。宏观社会关系中缺乏宽容礼让美德致使邻里矛盾升级,微观家庭关系中忽视互敬互谅激化日常琐事酿造悲剧,新市民群体“边缘化”暴露社会支持网络不健全,基层调解组织不作为降低了“息讼止争”的质效。因此,以和合文化为指导,有助于进一步完善矛盾化解长效机制,树立正确的价值观念、完善人民调解制度、提升警务调解实效性以及提高“息讼止争”的司法质效,为社会和谐稳定提供理论与制度支持。As the essence of traditional Chinese culture,Hehe culture emphasizes tolerance,mutual respect,understanding,and harmonious coexistence.It holds significant theoretical and practical value in preventing civil disputes from escalating into criminal cases.Law enforcement and judicial practices have shown that deviations from Hehe cultural principles are deep-seated factors contributing to such escalations.A lack of virtues like tolerance and courtesy in broader social relations exacerbates neighborhood conflicts,while neglecting mutual respect and understanding in family dynamics intensifies trivial disputes into tragedies.Additionally,the marginalization of new urban residents highlights deficiencies in social support networks,and the inaction of grassroots mediation organizations undermines the effectiveness of dispute resolution.Therefore,adopting Hehe culture as guidance can enhance long-term conflict-resolution mechanisms,foster correct values,improve the people's mediation system,enhance policing mediation effectiveness,and boost judicial efficiency in dispute resolution,thereby providing theoretical and institutional support for social harmony and stability.
