摘　　要：现代大学法人制度是现代大学建设的基本法律制度。通过剖析欧美大学法人制度的内涵、属性,循迹溯源了大学法人制度发展历程以及审视中国现代大学法人制度的实践探索,提出了分类放权、分层放权的基本思路,并建议通过签订行政合同、设立缓冲机构和落实大学章程的修订和实施等路径,更好地厘清大学内部治理与外部治理的各种关系,切实助力大学实现高质量发展。The legal person system of modern universities is the basic legal system for the construction of modern universities.By analyzing the connotations and attributes of the global university legal person system,tracing the development process of the university legal person system and the practical exploration of the modern university legal person system in China,the basic ideas of classified and hierarchical decentralization are proposed.It is suggested to clarify the various relationships between internal and external governance of universities through signing administrative contracts,establishing buffer institutions,and implementing the revision and implementation of university charters,and effectively help universities achieve high-quality development.
