摘　　要：英国法院审理了全球首例以比特币文件格式为争议客体的版权诉讼。原告对比特币文件格式主张专有版权,提出司法诉求以制止他者的直接或间接使用。法官对客体可版权性提出强烈质疑:一是文件格式版权内容存疑;二是文件格式固定形式存疑。最终法官以比特币文件格式未满足固定标准而否决其可版权性。比特币文件格式是专属于比特币系统的数据模型,以系统数据处理为核心任务,其可版权性评议宜以内容维度为首,并辅以版权固定标准。技术迭代催生出新一轮可版权性议题,版权内容、固定标准争议皆是新要素演化出的新问题。对此须保持包容审慎心态从而为新技术应用提供响应及时、保护合理的制度保障。The British court has heard the world's first copyright lawsuit using the bitcoin file format as the object of the dispute.The plaintiff claims proprietary copyright on the Bitcoin file format and makes a judicial appeal to stop the direct or indirect use of other parties.The judge raised strong questions about the object of copyright:the copyright content is in doubt,and the fixed format is in doubt.In the end,the judge rejected the bitcoin file format for not meeting the fixed standards.Bitcoin file format is a data model exclusive to the Bitcoin system.It takes the system data processing as the core task,and its copyright evaluation should be led by the content dimension and supplemented by the fixed copyright standard.Technology iteration evokes a new round of copyright issues,copyright content,fixed standard disputes are new problems out of the evolution of new elements.In this regard,we must remain inclusive and prudent to provide timely and reasonable institutional guarantee for the application of new technologies.
