摘　　要：银行业涉外监管法律建设是中国金融法治和涉外法治的重要组成部分。本文着力于从理论逻辑、历史逻辑和政策逻辑来认识中国银行业涉外监管法律建设的历史演进、宝贵经验和现实挑战,并从完善银行业金融监管涉外法律体系、优化体制机制、统筹涉外金融监管法治与金融高水平开放、健全反制裁法律法规、加强与国际金融监管标准接轨等方面提出相应针对性对策建议,为中国银行业涉外监管法律建设,有效统筹金融高水平开放、金融风险防范和金融高质量发展提供理论和政策支撑。The legal construction of foreign-related regulation in the banking industry is an important component of China’s financial rule of law and foreign-related rule of law.This paper focuses on the historical evolution,valuable experience and practical challenges of the legal construction of foreign-related regulation in China’s banking industry from the perspectives of theoretical logic,historic logic and policies’logic.The paper also proposes targeted countermeasures and suggestions in areas such as perfecting the foreign-related legal system of financial regulation,optimizing institutional mechanisms,coordinating the construction of foreign-related financial regulatory rule of law and high-level financial opening-up,improving anti-sanction laws and regulations,enhancing alignment with international financial regulation standards.These suggestions aim to provide theoretical and policy support for the construction of foreign-related financial regulatory laws in China’s banking industry,and the coordination of high-level financial opening-up,financial risk prevention and high-quality financial development.
