摘　　要：鉴于传染病防控中的利益冲突本质上是正当利益需求间的竞合,传染病防控法治以利益协调为最终指向,在实践中主要聚焦于行政应急与传染病救治,具体表现为利益保护与利益限制两个面向。传染病防控法治的完善,需以民生利益的识别与整合为依托,对个体、群体及社会的正当利益需求予以有效识别和公度性衡量。以权利的限制、保护与救济为向度,将人本理念和民本追求融入传染病防控法权规范的范畴。通过公众参与规则的健全、公共卫生服务信息披露制度的创设和社会救助法律保障制度的强化,将利益协调融入传染病防控法权规范的范畴。Given that the conflict of interest in the prevention and control of infectious diseases is essentially the competing demands of legitimate interests, the rule of law for the prevention and control of infectious diseases is based on the coordination of interests as the ultimate direction. In practice, it focuses primarily on administrative emergencies and medical treatments for infectious diseases, manifesting in the dual aspects of interest protection and interest limitation. The improvement of the rule of law for the prevention and control of infectious diseases needs to be based on the identification and integration of people's interests, so that the legitimate interests of individuals, groups and society can be effectively identified and measured in terms of fairness. In the direction of limitation, protection and relief of rights, the humanistic concept and people-oriented pursuit should be integrated into the scope of legal norms for the prevention and control of infectious diseases, and the coordination of interests should be integrated into the scope of legal norms for the prevention and control of infectious diseases. Through the improvement of the rules of public participation, the creation of an information disclosure system for public health services, and the strengthening of the legal protection system for social assistance,,we will ensure that the measurement of interests is integrated into the scope of the legal norms for the prevention and control of infectious diseases.
