摘　　要：人民健康是人民幸福的基础。医药领域腐败问题对人民群众的生命健康影响是严重的,直接的。以国家医药领域腐败问题集中整治工作为契机,重点聚焦全链条中医药购销领域“关键少数”和关键岗位最容易产生的商业贿赂问题,以现行《反不正当竞争法》《刑法》为法律依据,探讨医药领域商业贿赂的特点、成因、危害、法律缺陷,以期为有效规制医药领域商业贿赂行为提出对策与建议。The issue of corruption in the pharmaceutical field has a severe and direct impact on the life and health of the Chinese people.Taking the concentrated rectification of corruption in the national pharmaceutical sector as an opportunity,it focuses on the"key minority"and critical positions in the entire chain of Chinese medicine procurement and sales,where commercial bribery is most likely to occur.Using the current"Anti-Unfair Competition Law"and"Criminal Law"as legal bases,this research explores the characteristics,causes,harms,and legal flaws of commercial bribery in the pharmaceutical field,with the aim of proposing countermeasures and recommendations for effectively regulating commercial bribery in the pharmaceutical industry.
