从“医药反腐风暴”看医师执业的法律边界

摘　　要：从2023年5月开始,国家相关部门开展了力度空前的医药领域反腐工作,收效良好。在中央纪委国家监委网站和其他媒体曝光的众多案件中,以医师腐败为主导的案例并不鲜见。由此,以医药反腐风暴为视角,以医师腐败为切入点,从医师执业法律边界的内涵、医师越界执业腐败的表现形式、规制医师越界执业腐败的对策等问题入手,以期理清思路,从而为解决医师医药腐败问题提供有效参考。Since May 2023, the relevant state departments have launched an unprecedented anti-corruption campaign in the pharmaceutical sector, yielding significant results. Among the many cases exposed by the Central Commission for Discipline Inspection and the National Supervisory Commission and other media outlets, cases dominated by physician corruption are not uncommon. Viewing this issue through the lens of the anti-corruption storm in the pharmaceutical sector, and focusing on physician corruption, this paper examines the connotations of the legal boundaries of medical practice, the forms of corrupt practices by physicians who exceed these boundaries, and countermeasures to regulate such practices. The aim is to clarify the issues and provide effective references for resolving the problem of physician corruption.
