数字时代植物新品种权保护法治化研究

摘　　要：数字时代快速发展为植物育种和农业生产带来了巨大变革,提升了育种效率,同时也对植物新品种权的法治化保护提出新挑战,带来了信息泄露和数据安全问题,使传统法律框架面临一定压力。通过阐述国际和我国植物新品种权保护现状,剖析现有保护机制在法律法规和执法方面的不足之处。为此,提出完善法律法规、加强执法机制、推动国际合作和应用新技术等对策,旨在构建适应数字化发展的新品种权保护体系,提升植物新品种权保护工作法治化水平,为促进农林产业高质量发展提供有力的制度支撑。最后展望未来应继续关注数字技术的发展动态,提升公众意识,共同有效保护植物新品种权,深入推进产权保护法治化。The rapid development of the digital age has brought tremendous changes to plant breeding and agricultural production,improving breeding efficiency.At the same time,it has also posed new challenges to the legal protection of plant variety rights,resulting in information leakage and data security issues,putting pressure on traditional legal frameworks.By elaborating on the current status of international and Chinese plant variety rights protection,analyzing the shortcomings of existing protection mechanisms in terms of laws,regulations,and law enforcement.To this end,measures such as improving laws and regulations,strengthening law enforcement mechanisms,promoting international cooperation,and applying new technologies were proposed,aiming to build a new variety rights protection system that adapts to digital development and improve the legalization of the protection of new plant variety rights,and provide strong institutional support for promoting the high-quality development of agriculture and forestry industry.Finally,looking forward to the future,efforts should continue to pay attention to the development of digital technology,enhance public awareness,jointly effectively protect the right of new varieties of plants,and further promote the legalization of property rights protection.
