摘　　要：在新质生产力背景下,算法推荐技术广泛应用于体育赛事之中,实现了赛事节目传播范式的变革和服务质量的提升,但也面临着日益严峻的法律风险。该研究通过文献资料和案例研究等方法,在阐明算法推荐技术与体育赛事融合的基础上,探讨了体育赛事算法推荐的运行机制、法律难题和治理路径。研究表明,体育赛事算法推荐经历体育数据收集、体育数据分析、体育数据审核、体育用户画像标签提取以及体育数据推荐五个阶段;虽然体育赛事算法推荐降低了大规模信息推荐的决策成本,有效解决了信息冗余问题,促进了个性化体育赛事的精准推送,但也引发了运动员合法权益受损、体育赛事网络平台权力异化、社会公众知情权与隐私权被侵犯等新的法律难题。基于此,该研究提出相应的治理路径:提高网络平台对体育赛事算法推荐的注意义务;网络平台应承担体育赛事算法推荐的反垄断义务;网络平台应引入透明度义务和用户拒绝权等。In the context of new-quality productivity,algorithmic recommendation technology has been widely applied in sports events,leading to a paradigm shift in event broadcasting and an enhancement in service quality.However,it also faces increasingly severe legal risks.Through methods such as literature review and case studies,this research explores the integration of algorithmic recommendation technology with sports events,examining its operational mechanisms,legal challenges,and governance pathways.The study reveals that sports event algorithmic recommendation involves five stages:sports data collection,sports data analysis,sports data review,sports user profiling,and data recommendation.While this mechanism reduces the decision-making costs of large-scale information recommendations,effectively addresses information redundancy,and facilitates precise and personalized sports event recommendations,it also raises new legal issues,including the infringement of athletes’legitimate rights,the alienation of power on sports event platforms,and violations of the public’s right to know and privacy.Based on these findings,the study proposes governance pathways,including enhancing the duty of care of platforms for sports event algorithmic recommendations,imposing antitrust obligations on platforms,and introducing transparency requirements and user refusal rights.
