检察建议在犯罪治理中的逻辑进路与实践面向

摘　　要：犯罪治理是由源头预防、诉前分流、诉中化解、诉后治理四个环节组成的社会越轨行为综合治理体系。依法充分参与犯罪治理,是检察机关履行刑事诉讼主体责任的必然逻辑、刑事检察依法全面履职的具体表现、“加强检察机关法律监督工作”的重要方面,对推动刑事检察工作现代化具有重要意义。检察建议是检察机关全面充分履行法律监督职责的必要方式、增强法律监督工作质效的重要手段、提升法律监督权威的有效载体,切入犯罪治理体系的点位及作用主要体现为在源头预防、诉前分流、诉中化解、诉后治理四个环节分别发挥提醒、控制、息讼、建制作用。以检察建议推动犯罪治理,一方面需要依托司法诉讼职能,运用个案检察建议,高质效办好每一个案件,妥善处置社会矛盾纠纷;另一方面需要依托司法诉讼延伸职能,充分运用类案检察建议,服务构建共建共治共享社会治理新格局。Crime governance is a comprehensive management system of social deviant behavior composed of four links: source prevention, diversion before prosecution, resolution in prosecution and governance after prosecution.To fully participate in crime governance according to law is the inevitable logic for the procuratorial organs to fulfill their duties stipulated by the Criminal Procedure Law, the concrete manifestation of the criminal procuratorial work fully performing their duties according to law, and the important aspect of “strengthening the legal supervision of the procuratorial organs”, which is of great significance to promoting the modernization of criminal procuratorial work. Procuratorial advice is the necessary way to fully perform the duties of legal supervision, strengthen the legal supervision quality ef fect of important means, improve the ef fective carrier of legal supervision authority, cut into the crime governance system point and function is mainly reflected in the source of prevention, before shunt, v. dissolve, after governance four levels respectively play to remind, control, litigation, organizational system. On the one hand, we should rely on the function of judicial litigation, handle the case with high quality and e ffi ciency,and properly resolve disputes;on the other hand, we should rely on the judicial litigation extension function,use the procuratorial suggestion to build a new pattern of co-construction, co-governance and sharing social governance.
